Washington settles generic drug cases with Ascend Laboratories, Citron Pharma, and Mayne Pharma

Washington, as part of a bipartisan coalition of 45 states and territories, has reached settlements with Ascend Laboratories, Citron Pharma and Mayne Pharma to resolve allegations the generic drug manufacturers engaged in a long-running conspiracy to artificially inflate and manipulate prices and reduce competition.

Ascend will pay $400,000 to the states. Mayne will pay $650,000. Citron’s settlement only includes non-monetary terms as it has ceased business operations. As part of the settlement, the companies each agreed to change their practices to ensure fair competition and compliance with antitrust laws.

The coalition of nearly all states and territories, led by Connecticut, is engaged in a series of antitrust cases involving generic drug manufacturers, starting first in 2016. The trial scheduled for February in Hartford, Conn., focuses on the states’ dermatology case. In their complaint, the states allege that 26 corporate defendants and 10 individual defendants conspired to fix prices and allocate markets on over 80 topical generic drugs that account for billions of dollars of sales in the United States. The states previously reached settlements with Sandoz, Fougera, Glenmark, Lannett, Bausch, Apotex, Heritage, and Heritage’s parent company, Emcure, totaling $496.5 million.

Consumers who purchased a generic prescription drug between May 2009 and December 2019 may be eligible for compensation. To determine eligibility, call 1-866-290-0182 (Toll-Free), email info@AGGenericDrugs.com or visit www.AGGenericDrugs.com. Consumers can submit a claim for compensation here.

Washington and Idaho were the only states in the coalition to also secure restitution for businesses impacted by this conspiracy. Businesses in Washington that indirectly bought one or more of the generic prescription drugs at issue in the states’ cases or provided reimbursement for some or all of the purchase price may be eligible for compensation. The timeframe included in the settlement is May 2009 to December 2019.
